On February 23, 2018, the Government of Vietnam promulgated Decree 22/2018/ND-CP to detail certain provisions and measures for the implementation of copyright and related rights under the Intellectual Property Law 2005 as amended and supplemented in 2009. The decree stipulates the time limits for the issuance, reissuance, and alteration of the Certificate of Copyright and Related Rights, attracting considerable attention.
To be specific, Decree 22 provides the following timelines for granting Certificates of Copyright Registration and Certificates of Related Rights Registration:
- Within 07 working days from the date of receipt of a valid application, the Ministry of Culture, Sports, and Tourism (Copyright Office) is responsible for re-issuing the Certificate of Copyright Registration and the Certificate of Related Rights Registration.- Within 12 working days from the date of receipt of a valid application, the Ministry of Culture, Sports, and Tourism (Copyright Office) is responsible for exchanging the Certificate of Copyright Registration and the Certificate of Related Rights Registration.
In cases of refusal to re-issue or exchange the Certificate of Copyright Registration and the Certificate of Related Rights Registration, the Ministry of Culture, Sports, and Tourism (Copyright Office) must notify the applicant in writing.
