Drivers Have the Right to Refuse Passengers with Dangerous Infectious Diseases

This is a noteworthy provision stipulated in Circular 10/2015/TT-BGTVT which regulates responsibilities and the handling of violations in motor vehicle transportation activities, issued by the Minister of Transport on April 15, 2015.

Circular 10/2015/TT-BGTVT stipulates the responsibilities of drivers and vehicular service personnel in transport operations by automobile as follows:

- Properly execute the Transport Order issued by the enterprise or cooperative; ensure security and order on the vehicle; pick up and drop off passengers at the departure and destination bus stations, designated pick-up points, and follow the correct itinerary;- Do not carry more passengers than allowed and do not exceed the total permissible weight for traffic participation as stated in the Certificate of Technical Safety and Environmental Protection of the automobile; luggage and goods must be evenly arranged in the luggage compartment, ensuring no shifting during transport; prohibited items, flammable or explosive items, and live animals must not be transported;- Ensure every passenger on the vehicle has a ticket; guide and arrange for passengers to sit according to their tickets, disseminate vehicle regulations, assist passengers (especially persons with disabilities, the elderly, pregnant women, and children); maintain a civilized and polite service attitude;- Comply with legal provisions on maintaining public order and traffic safety;- Have the right to refuse transport to passengers who disrupt public order, obstruct the work of drivers or vehicle service personnel, commit ticket fraud, or are affected by dangerous diseases. Refuse to operate the vehicle when identifying that the vehicle does not meet safety conditions, does not have a journey monitoring device, or has a non-functional one.

In addition, cargo handlers also have the following responsibilities in transport operations by automobile:

- Receive information from the transporter to carry out the loading of goods onto the automobile conformably;- Load goods on the automobile not exceeding the permissible load and the load and size limits of bridges, tunnels, and roads on the entire cargo transport route;- Shield, bind, and support goods as regulated and under the guidance of the driver or freight supervisor;- Be responsible for violations regarding cargo loading unless it is proven that such violations were due to following the transporter's instructions or due to incorrect information provided by the transporter.
