Recently, the Government of Vietnam issued Decree 117/2020/ND-CP stipulating the administrative penalties in the field of healthcare.

Drinking Alcohol During Working Hours, May Be Fined Up To 1,000,000 VND (Illustrative Image)

According to Article 30 of Decree 117/2020/ND-CP, which stipulates penalties for violations of regulations on drinking alcohol and places where alcohol is prohibited, the following penalty levels may be applied:

- Warning or a fine between 200,000 VND and 500,000 VND for persons aged 16 to under 18 drinking alcohol.

- A fine between 500,000 VND and 1,000,000 VND for any of the following acts:

- Drinking alcohol at places where it is prohibited by law;- Inciting, provoking, or luring others into drinking alcohol.

- A fine between 1,000,000 VND and 3,000,000 VND for any of the following acts:

- Drinking alcohol immediately before, during working hours, study hours, or during breaks of working hours, study hours;- Forcing others to drink alcohol.

Additionally, violations regarding the sale and supply of alcohol are subject to the following penalties:

- A fine between 1,000,000 VND and 3,000,000 VND for any of the following acts:

- Selling or supplying alcohol to persons under 18 years of age;- Failing to post a notice prohibiting the sale of alcohol to persons under 18 years of age in a conspicuous place at the alcohol selling establishment.

- A fine between 5,000,000 VND and 10,000,000 VND for any of the following acts:

- Selling alcohol at places where it is prohibited by law;- Opening a new alcohol selling point for on-site consumption within a radius of 100 meters from the premises of healthcare facilities, nurseries, kindergartens, or primary and secondary schools.

- A fine between 10,000,000 VND and 20,000,000 VND for selling alcohol through e-commerce channels without meeting one of the conditions stipulated by law.
