Drinking Alcohol and Beer Easily Turns into Criminal Offenses

"An offender who commits a crime in a state of loss of awareness or control over their behavior due to consuming alcohol, beer, or other strong stimulants, shall still bear criminal responsibility." (Article 13 Criminal Code 2015)

Recently, in Nghe An, there was a suspected case where an older brother allegedly killed his younger brother due to a conflict while drinking alcohol. The incident was discovered when residents living nearby heard desperate cries for help coming from the house of Mr. Dao Khanh Hien (born in 1970, residing at Hamlet 32, Chau Binh Commune, Quy Chau District, Nghe An) and went over to see what was happening. Upon arrival, everyone was shocked to find Mr. Dao Khanh T. (born in 1973, residing in Ha Nam Province) - Hien's biological brother, lying dead in a pool of blood with many wounds on his body. Nearby, Mr. Hien was still sitting and drinking alcohol.

After conducting a crime scene examination and an autopsy, the police force determined that Mr. T was stabbed multiple times, leading to his death. Immediately afterward, the police arrested Hien to serve the investigation.

Annually, numerous cases occur due to the influence of alcohol and beer, particularly among middle-aged men and young men. These incidents stem from various reasons, such as pre-existing conflicts, economic pressure, or merely jokes made while drinking. Once alcohol is involved, no one can predict what might happen; they lose control over their actions and only realize the severity of the issue after the consequences have already occurred.

Drunkenness caused by alcohol and beer has extremely serious consequences for the individual, their family, and society. When intoxicated with alcohol and beer, the intoxicated person may have diminished or completely lost cognitive abilities and control over their actions, leading to behaviors such as murder, causing injuries, and notably, it is one of the causes of traffic accidents, among others.

Criminal law stipulates that “A person who commits a crime while in a state of loss of awareness or control of their actions due to the use of alcohol, beer, or other strong stimulants, shall still be held criminally responsible.” (Article 13 of the Criminal Code 2015) and committing crimes in a state of drunkenness, in some cases, is an aggravating circumstance increasing the criminal responsibility of that crime.

The Criminal Code 2015 came into effect on July 1, 2016.
