On April 12, 2024, the Minister of Justice issued Decision 639/QD-BTP on the Drafting Plan for the bill on promulgation of legislative documents (amended) in Vietnam.

The contents of the Drafting Plan for the bill on promulgation of legislative documents (amended) in Vietnam include:

1. Developing the Drafting Plan for the bill on promulgation of legislative documents (amended) in Vietnam to be submitted to the Ministry leadership for signing and promulgation; allocating human resources, budget, and other resources for implementing the Plan.

2. Establishing the Drafting Committee and Editing Team; conducting surveys at some ministries, central authorities, and local authorities; researching foreign experiences to develop a detailed outline of the Draft Law on Promulgation of legislative documents (amended); organizing workshops and seminars to gather feedback on the detailed outline of the Draft Law.

3. Developing the Project File for the Law on Promulgation of legislative documents (amended): Drafting the Submission Report; Drafting the Law; Reviewing related legislative documents; Administrative procedures evaluation report within the draft law; Gender equality integration report within the draft law on related issues; Foreign experience report related to the draft law; Compilations, explanations, and responses to feedback; other documents (if any).

4. Organizing meetings of the Drafting Committee and Editing Team to review and approve the detailed outline of the Draft Law on Promulgation of legislative documents (amended); discussing the content of the draft law, the Submission Report, and related documents; giving opinions on organizing public consultations for the project law, responses to feedback to finalize the draft before submission for appraisal, and responses to appraisal feedback to finalize the draft for submission to the Government of Vietnam.

5. Publishing on the electronic portal of the Government of Vietnam and the Ministry of Justice; organizing public consultations from agencies, organizations, individuals on the Draft Law on Promulgation of legislative documents (amended): written consultations, consultations through workshops, seminars, media coverage of the project law,...

6. Appraisal and explanation, responding to appraisal feedback on the Project of Law on Promulgation of legislative documents (amended).

7. Submitting the project of Law on Promulgation of legislative documents (amended) to the Government of Vietnam; finalizing and revising the project file according to the Government of Vietnam’s opinions.

8. Submitting the Project of Law on Promulgation of legislative documents (amended) to the Standing Committee of the National Assembly for review, opinions, and responses.

9. Submitting to the National Assembly for review and opinions (first time) on the project law.

10. Revising the draft law between two sessions based on National Assembly delegate opinions, reporting to the Standing Committee of the National Assembly on the revisions to the project law for submission to the National Assembly.

11. Submitting to the National Assembly for consideration and approval of the project law.

12. Announcing the Law.

The implementation of the Drafting Plan for the bill on promulgation of legislative documents (amended) in Vietnam must ensure the following requirements and objectives:

- Implementing the drafting of the Law on Promulgation of legislative documents (amended) based on policies approved by the Government of Vietnam.

- Developing the project file of the Law on Promulgation of legislative documents (amended) according to conformable standards, ensuring quality, and proposed progress.

- Clearly assigning tasks and responsibilities to each unit, group, and individual during the implementation process.

More details can be found in Decision 639/QD-BTP which takes effect in Vietnam from April 12, 2024.
