Dossier Requesting the Issuance of Cross-Border Transport Permit within the Mekong Sub-region

Recently, the Minister of Transport signed and promulgated Circular 89/2014/TT-BGTVT amending and supplementing certain provisions of Circular 29/2009/TT-BGTVT dated November 17, 2009, of the Ministry of Transport guiding the implementation of certain provisions of the Agreement on Facilitation of Cross-Border Transport of People and Goods among the Greater Mekong Subregion countries.

According to the provisions of Circular 89/2014/TT-BGTVT, the transport operator of enterprises or cooperatives crossing borders between countries in the Greater Mekong Sub-region must have professional qualifications in transportation from an intermediate level or higher, or a qualification from a college level or higher in other economics or technical disciplines; have at least 03 years of continuous work experience at the transport unit or 03 years of experience in transport management (for enterprises or cooperatives that do not require a transportation business license according to regulations).

Clause 3, Article 1 of Circular 89/2014/TT-BGTVT amends Clauses 2, 3, Article 6 of Circular 29/2009/TT-BGTVT which stipulates the dossier for the application for an international road transport permit for enterprises or cooperatives crossing borders among Greater Mekong Sub-region countries as follows:

- The application form for the GMS international road transport permit for enterprises, cooperatives as prescribed in Appendix 1 of this Circular;- A certified copy or a copy accompanied by the original for comparison of the automobile transport business license (for enterprises, cooperatives that require an automobile transport business license) or a business registration certificate with registered business lines for automobile transport (for enterprises, cooperatives that do not require an automobile transport business license);- A certified copy or a copy accompanied by the original for comparison of the diploma, certificate of the person directly managing transport of the enterprise, cooperative (only applicable to enterprises, cooperatives that do not require an automobile transport business license);- Financial statements of the enterprise, cooperative for the most recent 03 consecutive years certified by local financial authorities or an auditing unit.

The licensing authority is the Vietnam Road Administration. The licensing process is carried out in accordance with the provisions of this Circular as follows:

Step 1: Enterprises, cooperatives submit 01 dossier to the Vietnam Road Administration. The Vietnam Road Administration receives, checks the dossier; if incomplete, the Vietnam Road Administration shall notify the enterprise, cooperative on the working day to request supplementation and completion of the dossier. If the dossier is submitted by post or other means, if incomplete, within 02 working days from the date of receipt of the dossier, the Vietnam Road Administration must send a written request to the enterprise, cooperative for dossier supplementation and completion.

Step 2: Within 02 working days from the date of receipt of complete and conformable dossier, the Vietnam Road Administration must issue the permit; if refusing to issue, must reply in writing, clearly stating the reason.

Note, enterprises, cooperatives must pay the licensing fee as prescribed by the Ministry of Finance.
