On April 20, 2018, the Ministry of Finance issued Circular 38/2018/TT-BTC regulating the determination of the origin of exported and imported goods.
For the goods intended for export and import that meet the conditions specified in Article 24 of Decree 08/2015/ND-CP, organizations and individuals have the right to request the customs authority to pre-determine the origin of those goods. The application dossier includes:
- Application form for pre-determination of the origin of export or import goods;- List of materials and supplies used for the production of goods, including information: product name, product code, origin of raw materials and supplies constituting the product, CIF price or equivalent price of raw materials and supplies provided by the manufacturer or exporter: 01 photocopy;- Brief description of the production process or Certificate of composition analysis provided by the manufacturer: 01 photocopy;- Catalogue or images of goods: 01 photocopy.
Organizations and individuals shall submit the application dossier for pre-determination of the origin of goods to the General Department of Customs through the customs electronic data processing system. In case the customs electronic data processing system is not available or malfunctioning, the customs declarant shall submit 01 set of paper documents to the General Department of Customs, including the aforementioned documents and an Application form for pre-determination of the origin of export or import goods.
