Dossier for registration of operation of arbitration centers in Vietnam

Recently, the Government of Vietnam issued Decree No. 63/2011/NĐ-CP detailing and guiding a number of articles of the Law on Commercial Arbitration.

According to Article 8 of Decree No. 63/2011/NĐ-CP of Vietnam’s Government, the registration of operation of arbitration centers shall be carried out as follows:

1. Dossier for operation registration:

A dossier for operation registration is a set of the following papers:

- An application for operation registration;

- A certified copy of the establishment license of the arbitration center; in case of submission of a copy, the original is required for comparison;

- A certified copy of the charter of the arbitration center; in case of submission of a copy, the original is required for comparison;

- The original or a certified copy of the paper proving the working office of the arbitration center.

2. Time limit for registration:

- Within 15 days after receiving a valid dossier, the provincial-level Justice Department shall grant an operation registration paper to the arbitration center.

- Within 7 working days after granting an operation registration paper to an arbitration center, the provincial-level Justice Department shall send one copy of this paper to the Ministry of Justice.

3. Establishment announcement

- After being granted an operation registration paper, an arbitration center shall announce its establishment under Article 26 of the Law on Commercial Arbitration and have a seal carved in accordance with law.

- An arbitration center may commence its operation from the date it is granted an operation registration paper.

The announcement of the establishment of arbitration centers is prescribed in Article 26 of the Law on Commercial Arbitration of Vietnam as follows:

+ Within 30 days after obtaining its operation registration paper, an arbitration center shall publish in 3 consecutive issues of a central daily or a local daily of the locality in which it registers its operation the following principal details:

  • Name and address of its head office;

  • Its operations;

  • Serial number of the operation registration paper, issuer and date of issuance;

  • Time of commencing its operation.

+ An arbitration center shall post up at its head office the details specified in Clause 1 of this Article and the list of its arbitrators.
