The Supreme People’s Court issued Decision 126/QD-TANDTC on April 6, 2023, announcing the list of fully expired legislative documents within the jurisdiction of the Supreme People's Court.

To be specific, 13 legislative documents will fully expire under the Supreme People’s Court from April 6, 2023.

According to the List issued with Decision 126/QD-TANDTC on April 6, 2023, the following legislative documents will fully expire under the Supreme People’s Court sector from April 6, 2023:

(1) Resolution 02/2005/NQ-HDTP guiding the implementation of certain provisions in Chapter VIII "Provisional Urgent Measures" of the Civil Procedure Code

(2) Resolution 02/2012/NQ-HDTP guiding the implementation of certain provisions Resolution 60/2011/QH12 on the enforcement of the law amending, supplementing certain articles of the Civil Procedure Code

(3) Resolution 03/2012/NQ-HDTP guiding the implementation of certain provisions in Part I "General Provisions" of the amended and supplemented Civil Procedure Code

(4) Resolution 04/2012/NQ-HDTP guiding the implementation of certain provisions on "Proof and Evidence" of the amended and supplemented Civil Procedure Code

(5) Resolution 05/2012/NQ-HDTP guiding the implementation of certain provisions in Part II "Procedures for First Instance Court Trials" of the amended and supplemented Civil Procedure Code

What are cases where legislative documents fully expire in Vietnam?

To be specific, according to Article 154 of the Law on Promulgation of legislative documents 2015, legislative documents fully or partially expire in the following cases:

- The effective duration stated in the document ends.

- Amended, supplemented, or replaced by new legislative documents from the same state agency that issued the document.

- Abolished by a document from a competent state agency.

- When a legal normative document expires, the detailed implementing document also simultaneously expires.
