Do Employees Have the Right to Dialogue at the Workplace?

This is a noteworthy content stipulated in Decree 149/2018/ND-CP recently issued by the Government of Vietnam on November 7, 2018, aiming to specifically regulate the implementation of democracy regulations at the workplace.

Decree 149 regulates workplace dialogue through direct exchanges between the employee and the employer or between the employees’ representative body and the employer. Workplace dialogues are conducted periodically or upon the request of either party.

The content of the dialogue, the number of participants, participant composition, time, and timing of the dialogue, as well as the dialogue organization process, are carried out according to the enterprise's Regulations on Democracy at the Workplace. It is noted that if the timing of a periodic dialogue coincides with the timing of the employee conference, the enterprise is not required to organize the periodic dialogue.

Additionally, Decree 149 also regulates the employee conference as follows:

- The employee conference is organized by the employer and the employees’ representative body at the workplace. The employee conference must be held at least once a year.- The employee conference can be organized in the form of a plenary conference or a delegate conference.- The content of the employee conference must comply with legal regulations.- The form of organization, content, participant composition, time, venue, process, responsibility for organization, and methods of disseminating the results of the employee conference must follow the enterprise's Regulations on Democracy at the Workplace.
