District-level People's Committees in Vietnam shall allocate annual budget for detention facilities (Illustrative image)
Article 24 of Decree 133/2020/ND-CP stipulates the responsibilities of local authorities in participating in the education and rehabilitation of prisoners as follows:
For the Provincial People's Committees in Vietnam:
- Direct, assign governments, agencies, departments, social organizations, mass organizations, and individuals under their management to cooperate with detention facilities in the management, education and rehabilitation, motivation, vocational training, job introduction support, and loan provision... to improve the material and spiritual life and assist prisoners preparing to complete their sentences in reintegrating into the community;
- Organize communication, propaganda, and education on policies and laws, eliminate stigma and discrimination against prisoners; disseminate experience and exemplary models in educating and assisting those who have completed their sentences in reintegrating into the community;
- Annually allocate the budget as per legal regulations for subordinate agencies, units, and the District People's Committee to serve the collaboration with detention facilities in educating and rehabilitating prisoners and individuals who have completed their sentences residing in the locality.
For the District People's Committees in Vietnam:
- Direct, guide, and inspect Commune People's Committees, agencies, organizations to cooperate with detention facilities in the management, education and rehabilitation, motivation, improving material and spiritual life, and assisting prisoners preparing to reintegrate into the community in the prevention of recidivism and legal violations;
- Annually allocate the budget as prescribed by law for subordinate agencies, units, and the Commune People's Committee to serve the collaboration with detention facilities in educating and rehabilitating prisoners and individuals who have completed their sentences.
For the Commune People's Committees in Vietnam:
- Require relatives and families to strictly comply with legal regulations, the internal regulations of detention facilities, and perform family obligations in motivating and educating prisoners, preventing legal violations;
- Administer administrative penalties or propose administrative penalties for individuals with legal violations within the management area of the detention facility;
- Notify and exchange information about prisoners' relatives and families, cooperate in carrying out tasks upon request; verify the economic circumstances of prisoners' relatives accurately, and any related documents to serve as a basis for evaluating rehabilitation classification and implementing the legitimate rights, obligations, and interests of prisoners.
