Decree No. 137/2018/ND-CP issued by the Government of Vietnam on October 08, 2018, specifically stipulates the dismissal of members of the National Bar Council and the President of the Vietnam Bar Federation.
Decree 137 stipulates that members of the National Lawyers' Council are dismissed when they fall under one of the following cases:
- Violating the provisions of the Constitution and laws when performing their duties, powers, and responsibilities; infringing upon the interests of the Vietnam Bar Federation and the Bar Association;- Failing to comply with the requirements, regulations, and decisions of state management agencies during the performance of their duties and powers as a member of the National Lawyers' Council after having received a written reminder;- Having their Lawyer Practice Certificate revoked;- Other cases as stipulated by the Charter of the Vietnam Bar Federation.
According to Decree 137, the President of the Vietnam Bar Federation is dismissed when falling under one of the following cases:
- Falling under one of the cases for dismissal of members of the National Lawyers' Council;- Exceeding the six-month period from the end of the term without convening the National Lawyers' Council to organize the Congress, except in cases of legitimate reasons;- Failing to implement periodic and annual reporting policies, failing to report on the performance of the tasks of the Vietnam Bar Federation as required by the Law on Lawyers for two consecutive years; failing to send regulations, decisions, and resolutions related to the organization of the Congress of the Vietnam Bar Federation to the competent authority within six months from the conclusion of the Congress.
