This is one of the important contents stipulated in Circular 49/2014/TT-BNNPTNT Regulations on judicial expertise in the agriculture and rural development in Vietnam, issued on December 23, 2014.
Dismissal of Judicial Experts in the Agriculture and Rural Development in Vietnam (Illustrative Image)
Pursuant to Article 8 of Circular 49/2014/TT-BNNPTNT, the procedure for dismissing judicial experts is stipulated as follows:
The cases of dismissal and the dossier requesting the dismissal of judicial experts in the field of agriculture and rural development are carried out in accordance with Clauses 1 and 2 of Article 10 of the Law on Judicial Assessment.
Annually, the heads of agencies and units under the Ministry review and submit the dossier requesting the dismissal of judicial experts to the Legal Department. The Legal Department shall preside, in cooperation with the Personnel Organization Department, over the inspection of the dossier and submit it to the Minister of Agriculture and Rural Development for consideration and decision within 10 days from the date of receipt of a valid dossier.
Annually, the Director of the Department of Agriculture and Rural Development shall preside, in cooperation with the Director of the Department of Justice, over the inspection of the dossier and prepare a list for submission to the Chairman of the Provincial People's Committee for decision on the dismissal of judicial experts at the local level.
