Disclosure of Statistical Information Classified as State Secrets Shall Be Handled According to the Law

The Law on Statistics 2015 was promulgated on November 23, 2015, and officially took effect on July 1, 2016. One of the notable contents of this Law is the provision on prohibited acts in the field of state statistics and the use of state statistical information.

To be specific, according to the provisions of Article 10 of the 2015 Statistics Law, the prohibited acts in state statistical activities and the use of state statistical information include:

- Failure to perform or performing incompletely, not promptly providing information according to statistical investigation plans, statistical reporting policies, and administrative data as decided by competent state agencies;- Falsifying or distorting statistical data and information;- Interfering, coercing, imposing, bribing, threatening, or enticing others to falsify or distort data, statistical information, and using statistical information;

- Improperly implementing the provisions in the statistical investigation plan, statistical reporting policies, using administrative data for statistical activities; arbitrarily modifying information when conducting investigations, statistical reporting, and providing information from administrative data;- Reporting, publishing, disseminating inaccurate statistical information;- Disclosing statistical information classified as state secrets; disclosing data, statistical information that has not been published; using data or information of agencies, organizations, and individuals for non-statistical purposes without the consent of the concerned agencies, organizations, and individuals;- Deciding on statistical investigations, promulgating statistical reporting policies contrary to the provisions of the law on statistics.

Prohibited acts in statistical activities and the use of statistical information outside of state statistics include:

- The acts prescribed in Points b, c, and e, Clause 1, Article 10 of the 2015 Statistics Law;- Collecting, disseminating statistical information classified as state secrets, infringing the interests of the State, the rights, and legitimate interests of organizations and individuals.

Any individual who violates the provisions of the law on statistics shall, depending on the nature and extent of the violation, be subject to disciplinary action, administrative penalties, or prosecution for criminal liability; if causing damage, they must compensate as per the provisions of the law.

This is stipulated in Article 11 of the 2015 Statistics Law.
