Disciplinary measures for act of disclosing information about contents of educational inspection in Vietnam

This is a notable content in Circular 51/2012/TT-BGDDT of the Ministry of Education and Training regulating the organization and operation of inspection activities of higher education institutions and professional secondary schools in Vietnam, issued on December 18, 2020.

in accordance with  Article 16 of Circular 51/2012/TT-BGDDT, it is regulated that the person issuing the inspection decision, the Head of the inspection team, officers assigned to perform independent inspection tasks, and other members of the inspection team committing any of the following acts shall, depending on the nature and severity of the violation, be subject to disciplinary action or recommended for criminal prosecution; if causing damage, they must compensate in accordance with the law in Vietnam:

- Abusing inspection position or authority to perform illegal acts, harassing, causing difficulties or annoyances for the inspected subjects;

- Inspecting beyond the authority, scope, or content as stated in the inspection decision;

- Intentionally making false conclusions, illegal decisions, or handling, protecting those who commit legal violations;

- Disclosing information and documents about the inspection content during the inspection process;

- Intentionally not detecting or detecting acts of legal violation to the extent of requiring administrative handling, disciplinary action, or recommending criminal prosecution but not handling them, handling insufficiently, not recommending handling, or not recommending criminal prosecution;

- Falsifying, forging, altering, destroying, or appropriating inspection records;

- Receiving bribes or acting as a bribe broker;

- Other acts of legal violation.

Agencies, organizations, or individuals as inspected entities committing any of the following acts shall, depending on the nature and severity of the violation, be subject to disciplinary action or recommended for criminal prosecution; if causing damage, they must compensate in accordance with the law in Vietnam:

- Failing to provide information or documents or providing inaccurate, dishonest information, appropriating or destroying documents or evidence related to the inspection content;

- Resisting, obstructing, bribing, retaliating, oppressing individuals performing inspection tasks, persons providing information and documents to the inspection activities; causing difficulties for inspection activities;

- Slander or false accusations against individuals performing inspection tasks;

- Bribing;

- Failing to implement, inadequately implementing, or not promptly fulfilling their duties and responsibilities as stipulated in the inspection conclusions or decisions on inspection handling.

More details can be found in Circular 51/2012/TT-BGDDT, which comes into force in Vietnam from February 3, 2013.
