Disciplinary measures against Vietnamese officials from September 20, 2020

On September 18, 2020, the Government of Vietnam issued Decree 112/2020/ND-CP on the disciplinary actions against Vietnamese officials and public employees.

According to Article 7 of Decree 112/2020/ND-CP, the disciplinary measures against Vietnamese officials include:

  1. Applicable to leading officials: Reprimand; Warning; Dismissal; relief of office.
  2. Applicable to officials who do not hold leading and managerial positions: Reprimand; Warning; salary step downgrade; removal from office.
  3. Applicable to officials holding leading and managerial positions: Reprimand; Warning; Demotion; Dismissal; removal from office.

In addition, this Decree specifies the seriousness of the violation is determined as follows:

- Violations with less serious consequences are violations of a nature and degree of harm that are not great, affecting the internal scope, affecting the reputation of agencies, organizations and working units.

- Violations causing serious consequences are violations of great nature, seriousness, harm, and impact outside the internal scope, causing bad public opinion among cadres, civil servants, public employees and people, reducing the prestige of agencies, organizations and working units.

- Violations causing very serious consequences are violations of great nature, seriousness and harm, scope of impact on the whole society, causing very pressing public opinion among cadres, civil servants, public employees and people, discrediting agencies, organizations and working units.

- Violations causing particularly serious consequences are violations of a particularly large nature, magnitude and harm, with a scope of far-reaching impacts on the whole society, causing particularly pressing public opinion among cadres, civil servants, public employees and people, discrediting the agency, organizations and working units.
