In this regard, Lawnet would like to answer as follows:

On February 21, 2024, the Ministry of Education and Training issued Official Dispatch 673/BGDĐT-KHTC on the implementation of Decree 97/2023/ND-CP.

Specifically, the Government issued Decree 97/2023/ND-CP dated December 31, 2023, amending a number of articles of Decree 81/2021/ND-CP dated August 27, 2021, regarding the mechanism of collecting and managing tuition fees for educational institutions of the national education system and the policy of exemption and reduction of tuition fees, supporting study costs; and service prices in the field of education and training (Decree 97/2023/ND-CP),.

To agree in implementation, on the basis of the opinion of the Ministry of Labor, War Invalids, and Social Affairs, the Ministry of Finance, the Ministry of Education and Training, proposed ministries, ministerial-level agencies, government-attached agencies, and central agencies of socio-political organizations, People's Committees of provinces and cities directly under the Central Government and educational institutions, implement Decree 97/2023/ND-CP as follows:

-Public educational institutions collect tuition fees for the school year 2023-2024 in accordance with the provisions of Decree 97/2023/ND-CP. In there:

+ Public Higher Education and Vocational Institutions that have announced tuition fees for the academic year 2023-2024 exceeding the prescription fee limit in Decree 97/2023/ND-CP shall adjust the tuition fees for the academic year 2023-2024 according to the provisions in Decree 97/2023/ND-CP.

The difference (which the educational institution has collected from the learners) must be returned to the learners or deducted from the next tuition collection period. At the same time, implement it publicly for learners and society to ensure consensus and unity in implementation.

+ For preschool and public education institutions

In case the People's Councils of the provinces and educational institutions have issued tuition frameworks or tuition collections for the school year 2023-2024 that increase compared to the tuition fee for the school year 2021-2022, the local budget ensures the difference increases compared to the tuition fee for the school year 2021-2022.

The level of support for each educational institution is considered by the local decision. In case the local budget does not guarantee the increasing difference compared to the tuition fee for the school year 2021-2022, the adjustment must be made in accordance with the provisions of Decree 97/2023/ND-CP; The higher difference (which the educational institution has collected from the learners) must be returned to the learners or deducted from the next tuition collection period.

+ Regulations that are not amended in Decree 97/2023/ND-CP shall continue to comply with the provisions of Decree 81/2021/ND-CP.

- People's Committees of provinces, cities, and educational institutions strengthen communication in order for learners to fully inform themselves of the tuition plan for the 2023–2024 school year and ensure publicity, transparency, and consistency in implementing, sharing, and supporting learners.

- Ministries, ministerial-level agencies, government-attached agencies, central agencies of socio-political organizations, and People's Committees of provinces and cities directly under the Central Government actively allocate funds in order to make tuition fees for those entitled to the regulations due to the adjustment of the tuition of educational institutions.
