Determining the Organization for Appraisal Fee Collection for Licensing the Use of Industrial Explosives

Recently, the Minister of Finance signed and issued Circular 53/2019/TT-BTC amending and supplementing certain provisions of Circular 148/2016/TT-BTC regulating the rates, collection, remittance, management, and use of fees for appraisal of licensing the use of industrial explosives.

Currently, organizations requesting competent state agencies to grant permits for the use of industrial explosives must pay a licensing appraisal fee for the use of industrial explosives as stipulated in Circular 148/2016/TT-BTC. Circular 53/2019/TT-BTC stipulates the following organizations have the authority to collect the licensing appraisal fees for the use of industrial explosives:

The Department of Technical Safety and Industrial Environment under the Ministry of Industry and Trade, the Department of Industry and Trade of provinces and centrally-run cities, and the General Department of Defense Industry under the Ministry of National Defense have the authority to grant permits for the use of industrial explosives according to Article 19 Decree 71/2018/ND-CP dated May 15, 2018, of the Government of Vietnam, Article 6 Circular 13/2018/TT-BCT dated June 15, 2018, of the Minister of Industry and Trade, and Articles 3 and 4 Circular 85/2018/TT-BQP dated June 23, 2018, of the Minister of National Defense, as the organizations collecting the appraisal fees for the permits to use industrial explosives stipulated in this Circular.

Additionally, Circular 53/2019/TT-BTC also regulates other contents related to the levels of fees, collection, submission, management, and use of appraisal fees for licensing the use of industrial explosives not specified in Circular 53 to continue to be implemented according to the provisions of Circular 148/2016/TT-BTC.

During implementation, if the related documents mentioned in Circular 53 are amended, supplemented, or replaced, the new amended, supplemented, or replaced documents will be followed.
