Determination of Preferential Policies for Wounded Soldiers Effective from June 1, 2013

Recently, the Government of Vietnam has consensually issued Decree 31/2013/ND-CP detailing and guiding the implementation of several provisions of the Ordinance on Preferential Treatment for Persons with Meritorious Services to the Revolution.

Policies of preferential treatment for war invalids are regulated by the Government of Vietnam in Article 31 of Decree 31/2013/ND-CP as follows:

- War invalids with a labor capacity reduction due to injuries from 81% or more are entitled to a monthly allowance. In case of particularly severe injuries: Completely severed or paralyzed two or more limbs; blindness in both eyes; severe mental illness leading to inability to perform daily activities independently are entitled to a special monthly allowance. War invalids receiving a special monthly allowance are not entitled to the regular monthly allowance.- War invalids with a labor capacity reduction due to injuries from 81% or more but living with families are entitled to a service provider allowance.- Persons injured, as concluded by the authorized Medical Examination Council, with a labor capacity reduction from 5% to below 21% due to injuries are entitled to a one-time allowance.

Regarding the time for receiving benefits

- For persons injured from October 1, 2005 (the day the Ordinance took effect), they are entitled to a monthly allowance from the month immediately following the injury;- For persons injured before October 1, 2005, they are entitled to a monthly allowance from January 1, 2013.

Documents required for benefits

- Certificate of injury.- Medical Assessment Council's injury examination record.- Decision on granting the War Invalids Certificate, Certificate of persons entitled to policies as war invalids, and injury allowance, subsidy.
