Recently, the Government has issued a document on land pricing regulations, which includes provisions on determining the land position in the construction of land price tables from January 1, 2025.

On June 27, 2024, the Government issued Decree 71/2024/ND-CP regulating land prices in Vietnam.
(1) Basis for determining land site in the construction of land price tables:
- For agricultural land: The land site in the land price table construction is determined by different areas and implemented as follows:
Site 1 is where plots of land have the most favorable factors and conditions;
Following Sites are where plots of land have less favorable factors and conditions compared to the immediately preceding Site.
- For non-agricultural land: The land site is determined based on each road, road segment, street, street segment (for residential land in urban areas, commercial and service land in urban areas, non-agricultural production land that is not commercial or service land in urban areas), road, road segment or area (for types of non-agricultural land specified in Clause 1, Article 18 of Decree 71/2024/ND-CP) and based on technical and social infrastructure conditions, production and business advantages; distance to political, economic, and commercial centers in the area, and implemented as follows:
Site 1 is where plots of land have the most favorable factors and conditions;
Following Sites are where plots of land have less favorable factors and conditions compared to the immediately preceding Site.
(2) Based on the provisions of clause (1) and the actual situation at the locality, the provincial People's Council shall specify criteria to determine the Site for each type of land and the number of land sites in the land price table. For plots or land areas with more or less favorable factors for land use, the provincial People's Council shall specify the increase or decrease in the price as follows:
- For commercial and service land, non-agricultural production land that is not commercial or service land with high profitability, advantages in using the land as a production, business, or commercial and service base; agricultural land within residential areas, within the boundaries of a ward's administrative area, the provincial People's Council shall specify a higher land price based on the actual local situation;
- For residential plots with more or less favorable factors affecting the land price compared to residential plots with the same land site in the land price table, the provincial People's Council shall specify an increase or decrease in the price based on the actual local situation.

Determining areas in the land price table construction is regulated in Article 18 of Decree 71/2024/ND-CP as follows:
- Types of land that need area determination in the land price table include:
Agricultural land, residential land in rural areas;
Commercial and service land in rural areas;
Non-agricultural production land that is not commercial or service land in rural areas;
Land for building headquarters of agencies, land for construction of public works, and other non-agricultural land in rural areas.
- Areas in the land price table construction are determined according to each administrative unit at the communal level based on crop yield, livestock, distance to production areas, product consumption conditions, transportation conditions for production, product consumption (for agricultural land); based on technical and social infrastructure conditions, production and business advantages; distance to political, economic, commercial centers in the area (for residential land in rural areas; commercial and service land in rural areas; non-agricultural production land that is not commercial or service land in rural areas; land for building headquarters of agencies, land for building public service works, land for public use, and other non-agricultural land in rural areas) and implemented as follows:
Area 1 is the area with the highest profitability and the most favorable infrastructure conditions;
Subsequent areas are areas with lower profitability and less favorable infrastructure conditions compared to the immediately preceding area.
Thus, according to the aforementioned regulations, areas in the land price table construction are determined according to each administrative unit at the communal level and based on the following grounds:
- Based on crop yield, livestock, distance to production areas, product consumption conditions, transportation conditions for production, product consumption (for agricultural land);
- Based on technical and social infrastructure conditions, production and business advantages;
- Distance to political, economic, commercial centers in the area (for residential land in rural areas; commercial and service land in rural areas; non-agricultural production land that is not commercial or service land in rural areas; land for building headquarters of agencies, land for building public service works, land for public use, and other non-agricultural land in rural areas).
