Details of the contents of law execution situation monitoring in Vietnam (Internet image)

Article 7 of Decree 59/2012/ND-CP stipulates that ministries, ministerial-level agencies, government-attached agencies and People's Committees at all levels shall monitor law execution situation on the basis of consideration, assessment of the following contents:

• Promulgation of legislative documents detailing implementation of law;

• Assurance of conditions for law execution;

• Law observance situation.

In addition, Article 8 of Decree 59/2012/ND-CP stipulates the contents of considering and assessing the promulgation of legislative documents detailing implementation of law as follows:

• Timeliness and completeness of the promulgation of detailing legislative documents.

• Consistency and synchronism of legislative documents.

• Enforceability of legislative documents.

In addition, Article 9 of Decree 59/2012/ND-CP stipulates the ccontents of considering and assessing the assurance of conditions for law execution as follows:

• Timeliness, sufficiency, appropriateness and effectiveness of law training and dissemination.

• Suitability of the organizational apparatus and the satisfying extent of human resource for law execution situation.

• The satisfying extent of funds and material facilities for assurance of law execution.

Article 10 of Decree 59/2012/ND-CP also stipulates the contents of considering and assessing law execution situation

• Timeliness and sufficiency in law execution of state agencies and competent persons.

• Accuracy and consistency in guidance on law application and in law application of state agencies and competent persons.

• Extent of law observance of agencies, organiza­tions and individuals.

More details can be found in Decree 59/2012/ND-CP, which comes into force from October 1, 2012.
