Detailed Guidance on Regulations Regarding Death Benefits Policies

Recently, Decree 143/2018/ND-CP has been issued by the Government of Vietnam, providing detailed regulations on the Law on Social Insurance and the Law on Occupational Safety and Hygiene concerning compulsory social insurance for employees who are foreign citizens working in Vietnam. This is the first Decree to provide detailed regulations on this issue.

The full text regarding death benefit policies as guided by Decree 143 is as follows:

(1) Funeral allowance is implemented according to the provisions of Article 66 of the Law on Social Insurance.

(2) Monthly survivor's allowance:

- Cases eligible for monthly survivor's allowance are implemented according to the provisions of Article 67 of the Law on Social Insurance;- The amount of the monthly survivor's allowance is implemented according to the provisions of Article 68 of the Law on Social Insurance.

(3) Lump-sum survivor's allowance:

- Cases eligible for lump-sum survivor's allowance are implemented according to the provisions of Article 69 of the Law on Social Insurance;- In cases where the deceased employee has relatives who are eligible for a monthly allowance but do not reside in Vietnam, a lump-sum survivor's allowance shall be provided;- The amount of the lump-sum survivor's allowance is implemented according to the provisions of Article 70 of the Law on Social Insurance.
