This is the main content of the Decree No. 141/2020/NĐ-CP of the Government of Vietnam on regulations on the recruitment regime for pupils and students of ethnic minorities, issued on December 08, 2020.
According to Article 7 of the Decree No. 141/2020/NĐ-CP of Vietnam’s Government, the recruitment quotas is stipulated as follows:
1. Principles of determining recruitment quotas
- Recruitment quotas are determined annually and assigned by competent agencies according to each profession and training level;
- Recruitment quotas shall be developed and proposed by the People's Committees of communes or wards and townships (collectively referred to as the People's Committees of communes).
2. Grounds for the proposal of recruitment quotas
- Based on the requirements of tasks, job positions, the number of people working and the number of payrolls of officials assigned to the job positions being officials;
- Based on job demand, job position, number of assigned employees, standards for professional titles, salary fund of public non-business units, for public employees;
- Based on the socio-economic development plan and orientation of the locality, there are candidates for election specified in Clause 1 Article 2 of Decree No. 141/2020/NĐ-CP.
3. The process of setting up recruitment quotas
- Annually, the commune-level People's Committees shall report their proposal for selection quotas to the district- or town-level People's Committees (hereinafter referred to as district-level People's Committees);
- The district-level People's Committees shall summarize and report the proposal on recruitment quotas to the People's Committees of the central-affiliated provinces and cities (hereinafter referred to as the provincial-level People's Committees);
- Provincial-level People's Committees shall base themselves on reports on proposals of localities and the provisions of Section 2. to develop and propose targets for election to the central government.
4. Proposing recruitment targets
Every year, within May, the President of the People's Committee of the province shall submit a request for approval of the selection quotas for recruitment by profession at the university or college level of pedagogy to the Ministry of Education and Training of Vietnam; recruitment quotas by professions at college and intermediate level with the Ministry of Labor, War Invalids and Social Affairs of Vietnam (Form No. 01 specified in the Appendix attached to Decree No. 141/2020/NĐ-CP).
5. Approving and assigning recruitment targets
- The Ministry of Education and Training, the Ministry of Labor, War Invalids and Social Affairs, according to their competence, shall assume the prime responsibility for, and coordinate with the Ministry of Home Affairs, the Ministry of Planning and Investment, the Ministry of Finance, and the Committee for Ethnic Minority Affairs to consider and assign recruitment targets for the People's Committees of the provinces;
- The time limit for approving and assigning recruitment quotas is 30 days at the latest from the date the presiding agency receives a complete dossier and submits the request for approval of the recruitment quota.
