Decree No. 138/2020/NĐ-CP: 02 conditions to be considered for promotion of officials rank in Vietnam

Specifically, according to Article 31 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, an official who fully meets the criteria and conditions specified at Points a, b and c Clause 3 Article 30 of Decree No. 138/2020/NĐ-CP shall be considered for promotion to the rank of officials in the following cases:

- Having outstanding achievements in public service activities during the time of holding the current official rank, recognized by competent authorities;

- Appointed to hold leadership and management positions in association with the requirements of the job position.

In particular, the requirements for outstanding achievements in public service activities according to the above regulations include emulation titles, forms of reward according to merit and achievements in performing tasks and public service of officials as follows:

- For raising the rank from employee rank or equivalent to officer rank or equivalent; from the rank of officer or equivalent to the rank of expert or equivalent: received the Certificate of Merit from the Prime Minister and won the title of Grassroots Emulation Fighter twice;

- For raising the rank from expert or equivalent to the rank of main expert or equivalent: rewarded with the Third-class Labor Medal and win the title of Emulation Soldier at the ministry, department, branch, province or central mass organizations level;

- For promotion from the rank of main specialist or equivalent to the rank of senior specialist or equivalent: awarded the First-class Labor Medal or achieved the title of National Emulation Fighter.

Based on the job position, in accordance with the officials rank structure of the agency employing officials approved by the competent authority, the agency employing officials shall report to the officials management agency for consideration and decision according to their competence or submitted to competent agencies for consideration and decision on the consideration of rank promotion for officials immediately after the officials satisfy the above provisions. Agencies managing officials are responsible before law for the standards and conditions of officials considered for rank promotion and keep and manage officials' registration dossiers for rank promotion consideration in accordance with law.
