On October 26, 2009, the Government of Vietnam promulgated Decree 94/2009/ND-CP providing guidance on the amended Law on Drug Prevention and Control regarding post-rehabilitation management.
Decree 94: Procedures for transferring persons having completed rehabilitation to the rehabilitation centers in Vietnam (Illustration)
According to Article 22 of Decree 94/2009/ND-CP, the Center must inspect the dossier and prepare a handover record when receiving a person who is subject to post-rehabilitation management measures. The handover record is made in triplicate; each party keeps one copy, and one copy is sent to the Department of Labor - Invalids and Social Affairs where the dossier was made to send the individual to the Center. The dossier for transferring a person having completed rehabilitation to the Center includes:
- The Decision of the Chairman of the District People's Committee to apply post-rehabilitation management measures at the Center;
- The dossier requesting the application of post-rehabilitation management measures at the Center as stipulated in Clause 2, Article 18 of this Decree.
In cases where the Center for Disease Treatment, Education, and Social Labor is also the post-rehabilitation management center, the Director of the Center for Disease Treatment, Education, and Social Labor must categorize and store the dossier separately, and simultaneously report to the Department of Labor - Invalids and Social Affairs.
