Decree 93: Promulgating the organizational structure of defense and security enterprises

According to current regulations, defense and security enterprises are state-owned enterprises established or reorganized to perform stable and regular tasks in industries, fields, and territories directly serving national defense and security or ensuring national secrecy and security.

An enterprise identified as a defense and security enterprise must meet the following conditions:

- Be a state-owned enterprise under the Ministry of Defense or Ministry of Public Security.

- Operate in the industries, fields stipulated in the Appendix on the List of Industries, Fields, or Territories directly serving national defense and security promulgated along with this Decree.

- Be assigned by a competent authority to produce, supply defense and security products, services, or carry out stable, regular defense and security tasks using state resources or the enterprise's resources aligned with the investment and establishment objectives.

Decree 93/2015/ND-CP stipulates that based on the scale and specific activities of the enterprise, the Ministry of Defense or Ministry of Public Security decides to apply the organizational management structure according to the Board of Members, General Director (Director), Controller (Control Board) model or the Company President, General Director (Director), Controller (Control Board) model.

Specifically, for defense and security enterprises operating in special industries, fields, the organizational management structure of the enterprise is decided by the Prime Minister of the Government of Vietnam.

Standards, conditions, procedures for the appointment, dismissal, reward, and discipline for management positions in defense and security enterprises are implemented according to the provisions of the Ministry of Defense and Ministry of Public Security.
