Decree 78: Guiding the Procedures and Formalities for the Registration and Management of Reserve Officers

In Article 10 of Decree 78/2020/ND-CP prescribing the order and procedures for registration and management of reserve officers:

1. Initial Registration

- Within 15 working days from the date subjects specified in Clause 1, Article 9 of this Decree return to their place of residence or place of work (according to the introduction letter of the competent agency or unit), they must bring the introduction letter and the reserve officer card to the commune-level Military Command or the district-level Military Command in localities without commune-level administrative units, or the agency or organization Military Command to register into the reserve officer list. In cases where the agency or organization does not have a Military Command, the head or legal representative of the agency or organization is responsible for organizing for the aforementioned subjects to go to the commune-level Military Command at their place of residence for registration;

- Within 10 working days, the commune-level Military Command or the agency or organization Military Command compiles the list of registered reserve officers and reports to the district-level Military Command where the reserve officers reside, work, or study for management.

2. Supplementary Registration

- Within 15 working days from the date a reserve officer has changes to registered factors, they must go to the commune-level Military Command, or the district-level Military Command in localities without commune-level administrative units, or the agency or organization Military Command for supplementary registration. In cases where the agency or organization does not have a Military Command, the head or legal representative of the agency or organization is responsible for organizing for the reserve officer to go to the commune-level Military Command at their place of residence for supplementary registration;

- Every month, the commune-level Military Command, agency, or organization Military Command consolidates the supplementary registration of reserve officers and reports to the district-level Military Command.

3. Transfer Registration

- Reserve officers, before transferring their place of residence or place of work from one district to another, must go to the local district-level Military Command to complete transfer procedures to the Military Command at the new place of residence or work;

- Within 15 working days from the date of arrival at the new place of residence or work, reserve officers must go to the commune-level Military Command or the district-level Military Command in localities without commune-level administrative units, or the agency or organization Military Command at the new place to register as prescribed in Clause 1 of this Article.

4. Absence Registration

- Reserve officers, when absent from their place of residence or working place:

For an absence of 30 days or more, reserve officers must report to the commune-level Military Command, or the agency or organization at their place of work or study. Monthly, if there are absent reserve officers, the commune-level Military Command or the agency or organization Military Command must compile and report to the district-level Military Command;

For reserve officers assigned and appointed to reserve mobilization units and absent for 03 months or more, the district-level Military Command must notify the receiving reserve officer units; when there is a general mobilization or partial mobilization order, reserve officers must immediately return to their place of residence or working place to be ready for duty.

- Reserve officers assigned to work, study, or work abroad, or go abroad for personal reasons:

For a period of 01 year or more, reserve officers must report to the commune-level Military Command, district-level Military Command in localities without commune-level administrative units, or the agency or organization Military Command where the reserve officer works or studies and submit the reserve officer card; within 10 working days from the date the reserve officer goes abroad, the commune-level Military Command or the agency or organization Military Command where the reserve officer works or studies must report to the district-level Military Command to register for long-term absence and submit the reserve officer card;

Within 15 working days from the date of returning to the place of residence or work from abroad, reserve officers must go to the commune-level Military Command, district-level Military Command in localities without commune-level administrative units, or the agency or organization Military Command where the reserve officer works or studies to re-register;

For a period of less than 01 year, the reserve officer must submit the reserve officer card to the commune-level Military Command, district-level Military Command in localities without commune-level administrative units, or the agency or organization Military Command where the reserve officer works or studies. Within 10 working days from the date the reserve officer goes abroad or returns from abroad, the commune-level Military Command or the agency or organization Military Command is responsible for reporting to the district-level Military Command where residence is registered.

5. Special Registration

- Reserve officers who are exempt from active service during wartime according to the provisions of Articles 5, 6, 7, 8, and 9 of Decree 14/2016/ND-CP dated March 15, 2016 of the Government of Vietnam, which prescribes specialized sectors and occupations suitable for the requirements of the Vietnamese People's Army for female citizens of military service age; citizens eligible for exemption from conscription during wartime and the training of second-class reservists; within 15 working days from the date the reserve officer receives an appointment decision to a position mentioned above, the agency or organization Military Command, or in cases without a Military Command, the head or legal representative of the agency or organization where the reserve officer works or studies will notify the local district-level Military Command in writing to register for exemption from active service during wartime;

- Reserve officers no longer holding the positions specified in point a of this clause, within 10 working days from the date they no longer hold positions eligible for exemption from active service during wartime, the agency or organization Military Command, or in cases without a Military Command, the head or legal representative of the agency or organization will notify in writing to the local district-level Military Command where they reside for re-registration.
