This content is stipulated in detail by the Government of Vietnam in Decree 42/2013/ND-CP on the organization and operation of educational inspection.
In accordance with Decree 42/2013/ND-CP, the Inspectorate of the Ministry of Education and Training has the position, function, and organization as follows:

- The Inspectorate of the Ministry of Education and Training is an agency of the Ministry of Education and Training, assisting the Minister of Education and Training in state management over inspection work, resolving complaints, denunciations, and anti-corruption in the field of education; conducting administrative inspections, specialized inspections in education, resolving complaints, denunciations, and anti-corruption as prescribed by law. The Inspectorate of the Ministry has its own seal and accounts.- The Inspectorate of the Ministry includes the Chief Inspector, Deputy Chief Inspectors, Inspectors, and other officials.
- The Chief Inspector of the Ministry of Education and Training is appointed, dismissed, and removed by the Minister after reaching consensus with the Chief Inspector of the Government of Vietnam.- Deputy Chief Inspectors of the Ministry are appointed, dismissed, and removed by the Minister upon the recommendation of the Chief Inspector of the Ministry.
- The Inspectorate of the Ministry has functional departments to carry out assigned tasks.- The Inspectorate of the Ministry is under the direction and management of the Minister and is subject to the direction on operations and guidance on professional methodologies from the Government Inspectorate of Vietnam.
