Decree 29: Each Province is Allowed to Establish Only One Notary Association

Decree 29/2015/ND-CP on the organization and operation of the inspection in the Agriculture and Rural Development sector was promulgated on March 15, 2015

Decree 29/2015/ND-CP stipulates that in each province and city under Central authority, a Notary Association is established as a provincial-level socio-professional organization for practicing notaries in the area in accordance with Clause 1, Article 39 of the Notary Law.

In detail:

- The Notary Association is organized and operates on the principles of self-management, transparency, non-profit, and self-responsibility for operational funds in accordance with the provisions of the Notary Law, this Decree, and the Charter of the national socio-professional organization of notaries.- The Notary Association has legal status, its own seal, and bank accounts.- The organization and operation of the Notary Association are subject to state management by the provincial People's Committee and guidance from the national socio-professional organization of notaries. The Notary Association is not allowed to issue resolutions, decisions, internal regulations, fee regulations, or other provisions contrary to the law and the Charter of the national socio-professional organization of notaries.- The Department of Justice, in coordination with the Department of Home Affairs, assists the provincial People's Committee in the state management of the organization and operation of the Notary Association in the locality.- The members of the Notary Association are practicing notaries in the area. Notaries must join the Notary Association before registering to practice notarization in places where there is already a Notary Association.- The rights and obligations of members of the Notary Association are stipulated by the Charter of the national socio-professional organization of notaries.
