Decree 216: Re-inspection of inspection conclusions in the Planning and Investment sector of Vietnam

Recently, the Government of Vietnam issued Decree No. 216/2013/ND-CP on the organization and activities of inspection in the Planning and Investment sector.

According to Article 27 of Decree No. 216/2013/ND-CP of Vietnam’s Government, the re-inspection of inspection conclusions in the Planning and Investment sector is regulated as follows:

- The Chief Inspector of the Ministry of Planning and Investment decides to re-inspect cases that have been concluded by the Director-General of the General Statistics Office, the Chairman of the People's Committee of centrally-governed provinces and cities, within the scope and authority of state management of the Ministry of Planning and Investment but have been found to have signs of legal violations when assigned by the Minister of Planning and Investment.

- The re-inspection decision includes the legal basis for the inspection, scope, subjects, content, tasks of the inspection, inspection deadline, head of the inspection team, Inspectors, and other members of the inspection team. Within a maximum of 03 working days from the date of signing the re-inspection decision, the person making the re-inspection decision must send the re-inspection decision to the person who signed the inspection conclusion and the subject of the re-inspection.

- Based on the re-inspection, the re-inspection period, re-inspection deadline, tasks, powers of the person making the re-inspection decision, head of the inspection team, members of the inspection team, and reporting the results of the re-inspection shall be carried out in accordance with the provisions of the Law on Inspection, Decree No. 86/2011/ND-CP and Decree No. 07/2012/ND-CP of Vietnam’s Government.

- The person making the re-inspection decision shall issue the re-inspection conclusion. The content of the re-inspection conclusion shall be implemented in accordance with the provisions of the inspection law.

- The re-inspection conclusion of the Chief Inspector of the Ministry of Planning and Investment shall be sent to the Minister of Planning and Investment and the Government Inspectorate.
