Decree 165: Liquidation of property at the Communist Party of Vietnam's agencies (Illustrative image)

Article 27 of Decree 165/2017/ND-CP stipulates the liquidation of property at the Communist Party of Vietnam's agencies. Property at the Communist Party of Vietnam's agencies shall be liquidated in the following cases:

+ Property that has expired according to legal regulations;

+ Property that has not yet expired but is damaged beyond repair or where repairs are not effective (estimated repair costs exceed 30% of the original property value);

+ Office building or other property attached to land that must be demolished according to the decision of a competent state agency.

- Liquidation of property at the Communist Party of Vietnam's agencies shall be made in the following forms: Demolition, destruction. Recovered materials and supplies from the demolition or destruction of property will be handled for sale; sale.

- Power to decide on the liquidation of property at the Communist Party of Vietnam's agencies:

+ The Chief of the Office of the Central Committee of the Communist Party of Vietnam decides or delegates the authority to decide on the liquidation of property at the Communist Party of Vietnam's central-level agencies;

+ The standing committee of the provincial CPV committee decides or delegates the authority to decide on the liquidation of property at the Communist Party of Vietnam's agencies that are subordinate units under the office of the provincial CPV committee;

+  The standing committee of the district-level CPV committee decides on the liquidation of property formed from the Communist Party of Vietnam''s reserve fund at the Communist Party of Vietnam's agencies which are budget units under the district budget;

+ The power to decide on property liquidation in cases not within the scope specified in points a, b, and c of this clause shall follow the legal regulations applicable to state agencies.

- The procedures and organization of property liquidation at the Communist Party of Vietnam's agencies are implemented according to the legal regulations applicable to state agencies.
