Decree 165: 05 regulations on the use of property at the Communist Party of Vietnam's agencies

On December 31, 2017, the Government of Vietnam promulgated Decree 165/2017/ND-CP on the regulations for the management and use of property at the Communist Party of Vietnam's agencies.

In Article 17 of Decree 165/2017/ND-CP, the regulations regarding the use of the property at the Communist Party of Vietnam's agencies are as follows:

- The use of property at the Communist Party of Vietnam's agencies must comply with the principles stipulated in Article 4 of this Decree.

- It is prohibited to lend property or use property for personal purposes.

- The Communist Party of Vietnam's agencies are allowed to use official residences, guest houses, and other property not fully utilized in accordance with relevant legal regulations and the regulations of the Communist Party of Vietnam.

- The Chief of the Office of the Central Committee of the Communist Party of Vietnam shall decide or delegate the power to decide on the use of property managed by the Communist Party of Vietnam's central-level agencies; the standing committee of the provincial CPV committee shall decide or delegate the power to decide on the use of property managed by Communist Party of Vietnam's local-level agencies.

- The revenue from the use of property as stipulated, after deducting the related costs and fulfilling financial obligations to the State according to the law, will be managed as follows:

- Be added to the operating fund of the Communist Party of Vietnam's agencies for the property allocated by the State in kind or invested, procured from the state budget;

- Be added to the reserve fund of the Communist Party's budget for property not falling within the scope of point an of this clause.
