Decree 140: Development of programs and projects regarding environmental protection in Vietnam

Recently, the Government of Vietnam issued Decree 140/2006/ND-CP on environmental protection in the stages of planning, appraisal, approval, and organization of the implementation of strategies, plannings, plans, programs, and development projects.

To be specific, Clause 2, Article 6 of Decree 140/2006/ND-CP stipulates the phase of development of programs and projects on environmental protection as follows:

- Environmental impacts must be considered right from the stage of research and formulation of development programs and projects.

- Investors of programs, socio-economic development projects, domestic investment projects, and foreign investment projects are responsible for preparing environmental impact assessment reports simultaneously with the process of formulating the program or preparing the project's feasibility study report to submit to the competent state authority for approval.

- The content of the environmental impact assessment report is implemented according to the provisions of Article 20 of the Environmental Protection Law.

- Investors of development programs and projects themselves or hire consulting service organizations to prepare environmental impact assessment reports and are responsible for the data and content stated in the environmental impact assessment reports.

- In case of changes in scale, content, implementation time, or completion of the program or project, the investor is responsible for explaining to the approving authority and must prepare additional environmental impact assessment reports when required by the competent authority.

- Provisions on environmental protection in the program development phase apply to the entire program and each project within the program.
