Decree 125/2015/ND-CP: Effect of flight permit in Vietnam from January 26, 2016

According to Decree 125/2015/ND-CP, the implementation time of each flight is defined by the contents of issued flight permit. To be specific:

- The flight permit for the departure and arrival flights at the airports or aerodromes of Vietnam is valid from twelve (12) hours prior to the estimated hour specified in the flight permit to twenty four (24) hours after the estimated hour of take-off and landing specified in the flight permit.

- The flight permit for the flights over the airspace of Vietnam is valid from three (03) hours prior to the estimated hour specified in the flight permit to seventy two (72) hours after the estimated hour specified in the flight permit.

- The validity of the flight permit consists of the flight permit for the flights from the alternate aerodrome to the arrival aerodrome or departure aerodrome.

Additionally, Decree 125/2015/ND-CP also stipulates the reasons for the cancellation of flight permits by the flight permit issuing body:

a) Security and national defense;

b) Safety and security of the flight;

c) Public order and interest;

d) Protecting the interests of the State;

đ) As stipulated by international treaties to which the Socialist Republic of Vietnam is a member;

e) The flight permit applicant provides untruthful information, performs the flight not according to the content of the flight permit, fails to fully pay the navigation service charges and other relevant fees, or engages in other deceptive acts.

When seeking to amend the content of an issued flight permit, the flight permit applicant must submit an application for amendment to the permitting authority and may only perform the flight after receiving confirmation from the permitting authority. The application for amending the flight permit includes the following details:

- Name, postal address, and telegraph address of the aircraft operator or carrier;

- Permit number and date of issuance;

- Details of the proposed amendment to the flight permit.

Note that the flight permit applicant must notify the permitting authority in advance of the intended flight execution time in the case of cancellation of an already issued flight permit.
