Decree 122: Which Agency Executes the Health Inspection Function?

The bodies performing the function of Medical Inspectorate are regulated by the Government of Vietnam in Decree 122/2014/ND-CP as follows:

State Inspectorate Agencies:

- Inspectorate of the Ministry of Health;- Inspectorate of the Department of Health.

Agencies assigned to perform specialized inspection functions:

- General Department of Population and Family Planning; Drug Administration; Administration of Medical Examination and Treatment; Administration of Environmental Health; General Department of Preventive Medicine; Food Safety Department (collectively referred to as Departments and Bureaus);- Sub-Department of Population and Family Planning, Sub-Department of Food Safety and Hygiene (collectively referred to as Sub-Departments).

The Inspectorate of the Ministry of Health and the Inspectorate of the Department of Health have their own seals and accounts.

Each agency is tasked with different duties and powers, specifically the Inspectorate of the Ministry of Health has the following duties and powers:

- Assisting the Minister of Health in state management of medical inspection work.- Presiding over or participating in the drafting of legal documents as assigned by the Minister of Health.- Preparing the annual medical inspection plan and submitting it to the Minister of Health for approval.- Guiding the Inspectorate of the Department of Health and the agencies assigned to perform specialized inspection functions under the Ministry of Health in preparing the annual medical inspection plan.- Being the standing agency for citizen reception work as prescribed by law.- Summarizing and reporting to the Minister of Health and the Chief Inspector of the Government of Vietnam on the results of inspection work, complaint and denunciation resolution, citizen reception, and anti-corruption within the scope of management of the Ministry of Health as prescribed by law.- ...
