Decree 114: Checking dam and reservoir acceptance in Vietnam

According to Article 8 of the Decree No. 114/2018/NĐ-CP of Vietnam’s Government, checking of dam and reservoir acceptance is as follows:

- Dam and reservoir acceptance shall be checked during construction and when constructed is completed as per provisions of the law on quality control and construction work maintenance.

- The state council for acceptance of construction works shall check the acceptance performed by the investor in construction of specially important dams and reservoirs and large-scale dams and reservoirs requiring complicated techniques according to the annual list decided by the Prime Minister.

- Construction-specialized agencies affiliated to the Ministry of Agriculture and Rural Development shall check the acceptance performed by the investor in construction of classed-I and specially-classed dams and reservoirs given by the Prime Minister and irrigational dams and reservoirs of which operation and use relate to 2 or more than 2 provinces irrespective of investment capital sources, except for specially important dams and reservoirs and large-scale dams and reservoirs requiring complicated techniques.

- Chairpersons of provincial People’s Committees shall assign agencies specialized in irrigation and hydroelectricity of provinces to check the acceptance performed by the investor under provincial power for investment decision and acceptance of irrigational and hydroelectric dams and reservoirs constructed in provinces irrespective of investment capital sources, except for dams and reservoir prescribed above.
