the Government of Vietnam has just issued Decree 02/2014/ND-CP stipulating the policies applied, and implementing administrative handling measures for sending individuals to reformatory schools and compulsory educational institutions.
In the case of temporarily removing students or trainees from reformatory schools or compulsory education institutions at the request of the criminal procedure-conducting agency, the regulations stipulated in Decree 02/2014/ND-CP shall be complied with as follows:
- When there is a request to remove students or trainees from the reformatory school or compulsory education institution, the head of the competent criminal procedure-conducting agency must issue a written document to the principal of the reformatory school or the director of the compulsory education institution, clearly stating the full name, date of birth, place of residence of the student or trainee, the reason, and the duration of the temporary removal. Based on the document from the criminal procedure-conducting agency, the principal of the reformatory school or the director of the compulsory education institution shall issue a decision to temporarily remove the student or trainee from the reformatory school or compulsory education institution to participate in legal proceedings.- The agency requesting the removal of the student or trainee from the reformatory school or compulsory education institution is responsible for transporting the student or trainee and returning them according to the deadline stated in the decision or when the requirement no longer exists. A handover record must be made when transferring and receiving.- The duration of the temporary removal of the student or trainee from the reformatory school or compulsory education institution is counted towards the duration of the decision implementation at the reformatory school or compulsory education institution.
