This is a noteworthy provision enacted by the Government of Vietnam in Decree 02/2014/ND-CP regulating policies for the application and implementation of administrative handling measures for compulsory education facilities and reformatories.
When placing individuals who have received decisions into reformatory schools, those subject to the measure must ensure compliance with the dossiers and procedures listed in Decree 02/2014/ND-CP as follows:
- When placing individuals in reformatory schools, there must be accompanying records. The records include:
- Decision of the district People's Court on the application of the measure of sending the individual to a reformatory school;- Summary of the background and violations of the law by the individual subject to the measure of sending to a reformatory school;- Biographical files and identification records of the individual subject to the measure of sending to a reformatory school;- Copies of applied educational decisions (if any);- Decision to hand over to the family, organization managing the individual subject to the measure of sending to a reformatory school during the procedure (if any);- Other documents related to the personal identity of the individual subject to the measure of sending to a reformatory school (if any).
- Upon handing over and receiving the individual with the decision to send to a reformatory school, a record must be made. The reformatory school must compare and check the individual received with the accompanying records and make a record specifying the documents in the file, the current health status of the received individual, personal belongings carried, and other related issues concerning the handover and reception.
