The Ministry of National Defense has just issued Circular 139/2015/TT-BQP providing guidance on unemployment insurance within the Ministry of National Defense.
Within 30 days from the effective date of the labor contract or employment contract of an employee subject to mandatory unemployment insurance, the employer must prepare and submit the unemployment insurance participation dossier of the employee to the Social Insurance of the Ministry of National Defense.
The unemployment insurance participation dossier is the mandatory social insurance participation dossier, which includes specific content regarding unemployment insurance participation.
Furthermore, in cases where an employee enters multiple labor contracts, all of which are subject to mandatory unemployment insurance, and is currently participating in unemployment insurance under the first effective labor contract, upon termination or modification of the labor contract currently participating in unemployment insurance leading to the employee no longer being subject to mandatory unemployment insurance, the employer under the successor labor contract subject to the provisions of labor law must prepare and submit the unemployment insurance participation dossier of the employee to the Social Insurance of the Ministry of National Defense within 30 days from the date the employee terminates or modifies the above-mentioned labor contract.
Circular 139/2015/TT-BQP takes effect from February 1, 2016; the policies regarding unemployment insurance in this Circular are applied from January 1, 2015.
