On October 7, 2020, the Government of Vietnam promulgated Decree 120/2020/ND-CP regulating the establishment, reorganization, and dissolution of public service providers in Vietnam.

According to Article 15 of Decree 120/2020/ND-CP on processing documents and the time limit for resolving the establishment of a public service provider in Vietnam:
1. Regarding the appraisal of the establishment of a public service provider in Vietnam
- The establishment of a public service provider under the decision-making authority of the Government of Vietnam, the Prime Minister of the Government of Vietnam, the appraisal time limit is 15 days from the date of receipt of complete documents as prescribed. The appraisal agency or organization must have a written appraisal sent to the agency or organization requesting the establishment.
- The establishment of a public service provider not under the decision-making authority of the Government of Vietnam, the Prime Minister of the Government of Vietnam, the appraisal time limit is 10 days from the date of receipt of complete documents as prescribed. The appraisal agency or organization must have a written appraisal sent to the agency or organization requesting the establishment.
2. Regarding the decision to establish a public service provider in Vietnam
- Within 25 days from the date the agency or organization requesting the establishment of a public service provider completes the documents according to the appraisal agency or organization's opinions and submits them as prescribed, the competent authority or person must issue a decision establishing the public service provider.
- In case the competent authority or person does not agree with the establishment of the public service provider, they must provide a written response (stating the reasons) to the agency or organization requesting the establishment of the public service provider.
Note: In cases where specialized law has different provisions on the appraisal time limit and the decision to establish a public service provider, the provisions of specialized law shall apply.
