Circular 12/2018/TT-BTP guiding professional activities of legal aid and managing the quality of legal aid cases was issued on August 28, 2018. Notably, this document includes the content of the criteria for assessing the quality of legal aid cases.
Specifically, according to Article 16 of Circular 12/2018/TT-BTP, the evaluation of the quality of legal aid cases is based on the following criteria and point structure:
* Criteria for professional responsibility of the legal aid provider (30 points)
- Compliance with the law, honesty, respect for objective truth (10 points);- Explain, guide, and promptly provide information about the case to the legal aid recipient (10 points);- Ensure the time and progress of case execution (10 points).
* Criteria for performing legal aid (60 points)
- Perform legal aid in accordance with the legal aid requirements and the assigned scope (05 points);- Gather information, documents, and evidence related to the case (10 points);- Research and fully apply relevant legal provisions to ensure the content of legal aid is accurate and compliant with the law (20 points);- Participate in litigation activities or engage in extrajudicial representation activities to promptly provide solutions to protect the lawful rights and interests of the legal aid recipient (20 points);- The legal aid process is fully documented in the case file (05 points).
* Criteria for the satisfaction of the legal aid recipient based on feedback from the legal aid recipient or their relatives (10 points).
This Circular also specifically stipulates the classification of the quality of legal aid cases as follows:
- High-quality case: Cases with a total score of 90 points or above;- Good-quality case: Cases with a total score of 70 to under 90 points;- Satisfactory quality case: Cases with a total score of 50 to under 70 points;- Low-quality case: Cases with a total score of under 50 points or cases where the legal aid provider or the legal aid organization violates the prohibitions stipulated in Clause 1, Article 6 of the Legal Aid Law.
