On December 26, 2024, the Minister of Justice of Vietnam issued Circular 16/2024/TT-BTP stipulating the standards and conditions for consideration for promotion of professional titles in legal support and professional support in the field of justice in Vietnam.

Criteria for consideration for promotion of professional titles in legal support and professional support in the field of justice in Vietnam

(1) General Conditions

According to Article 3 of Circular 16/2024/TT-BTP, the criteria for consideration for promotion of professional titles in legal support and professional support in the field of justice in Vietnam include:

- Being nominated by a competent agency, organization, or unit to participate in the consideration of professional title promotion.

- Meeting the standards and conditions for promotion consideration as stipulated in Clause 1, Article 32 of Decree 115/2020/ND-CP dated September 25, 2020, of the Government of Vietnam regarding recruitment, use, and management of public employees (amended and supplemented by Clause 16, Article 1 of Decree 85/2023/ND-CP dated December 07, 2023, of the Government of Vietnam amending and supplementing several articles of Decree 115/2020/ND-CP dated September 25, 2020, on recruitment, use, and management of public employees).

(2) Specific Conditions

Standards and Conditions for Promotion to Rank II Legal Support

A public employee may apply for consideration for promotion to the rank II legal support when meeting the standards and conditions specified in Article 3 of Circular 16/2024/TT-BTP and the following standards and conditions:

- Currently holding the rank III legal support.

- Meeting the job position requirements corresponding to the rank II legal support as regulated in Circular 06/2023/TT-BTP dated September 18, 2023, of the Minister of Justice, guiding job positions in leadership, management, specialized professional titles, and the structure of public employees by professional titles in public service providers related to justice.

- Meeting the requirements of the standards for the rank II legal support for each specific title as stipulated in Circular 15/2024/TT-BTP dated December 26, 2024, of the Minister of Justice, specifying the codes, and standards for professional titles of notary, auctioneer, legal support, and operational support in the field of justice.

- Having held the rank III legal support or equivalent for a cumulative period of at least 09 years (108 months) or more. In cases where the time held in an equivalent title to the rank III legal support is counted, the time held in the legal support grade III title must be at least 01 year (12 months), up until the end of the submission period for promotion application.

Standards and Conditions for Promotion to rank II professional support

A public employee may apply for promotion to the rank II professional support if meeting the standards and conditions specified in Article 3 of Circular 16/2024/TT-BTP and the following standards and conditions:

- Currently holding the rank III professional support.

- Meeting the job position requirements corresponding to the rank II professional support regulated in Circular 06/2023/TT-BTP dated September 18, 2023, of the Minister of Justice, providing guidance on job positions in leadership, management, professional specialized titles, and the public employee structure according to professional titles in public service providers in the justice sector.

- Meeting the requirements of the standard for the rank II professional support for each specific title as defined in Circular 15/2024/TT-BTP dated December 26, 2024, of the Minister of Justice, specifying codes, and standards for professional titles of notary, auctioneer, legal support, and operational support in the field of justice.

- Having held the rank III professional support or equivalent for a cumulative period of at least 09 years (108 months) or more. In cases where the time held in an equivalent title to the rank III professional support is considered, the time held in the operational support grade III title must be at least 01 year (12 months), calculated up to the end of the deadline for application submission for promotion.
