Regarding this matter, LawNet would like to answer as follows:

On March 25, 2024, the Inspector-General of Vietnam issued Circular 03/2024/TT-TTCP detailing regulations and guidelines for implementing certain provisions of the Law on Emulation and Commendation 2022 for the Inspectorate sector.

Criteria for awarding the Advanced Laborer title in the Inspectorate sector in Vietnam as of May 15, 2024

According to Article 3 of Circular 03/2024/TT-TTCP, the criteria for awarding the Advanced Laborer title in the Inspectorate sector as of February 15, 2024 are specified as follows:

- The "Advanced Laborer" title is awarded annually to individuals in the Government Inspectorate who meet the criteria specified in Clause 1 of Article 24 of the Law on Emulation and Commendation.

- Individuals who are selected to participate in short-term training or retraining for less than 1 year and comply with the regulations of the training institution will have their study time counted as working time in the agency, organization, or unit in order to be considered for the "Advanced Laborer" title.

In cases where individuals are selected to participate in training or retraining for 1 year or more, the time spent in training or retraining will be considered as working time for the purpose of considering for awarding the "Advanced Laborer" title. In addition to the general criteria and conditions, individuals must comply with the regulations of the training institution, complete their study, and achieve a grade of "good" or higher (for courses with average ratings such as average, good, excellent, etc.).

- Maternity leave in accordance with regulations will be used for the consideration of the "Advanced Laborer" title.

- In the case of individuals transferred to the Government Inspectorate during the year of commendation, the unit proposing the commendation for that individual is responsible for seeking comments and feedback from the previous workplace if the individual has worked at that unit for 6 months or more.

- In the case of individuals assigned or seconded to work in other agencies, organizations, or units for a certain period of time, the evaluation for the "Advanced Laborer" title will be conducted by the assigning or seconding agency or unit. The receiving agency, organization, or unit is responsible for providing comments and feedback on the individual's compliance with the Party's guidelines and policies, state laws, internal regulations, and the performance of assigned tasks during the assignment or secondment period.

- The "Advanced Laborer" title will not be considered for individuals in the following cases:

+ Individuals who have been recruited or have employment contracts for less than 6 months;

+ Individuals who have taken leave from work for a period of 3 to less than 6 months, except for maternity leave as prescribed;

+ Individuals who are under disciplinary consideration or are under investigation, inspection, or examination for suspected violations or whose complaints or accusations are being verified.

More details can be found in Circular 03/2024/TT-TTCP, which takes effect on May 15, 2024, and replaces Circular 01/2016/TT-TTCP dated October 6, 2016.

In the case where the referenced legislative documents in Circular 03/2024/TT-TTCP are amended, or replaced, the newly issued documents shall apply.
