Regarding this issue, LawNet answers as follows:
On December 25, 2023, the Government issued Decree 93/2023/ND-CP regulating the consideration and awarding of the titles "People's Artisan", "Artisan of Merit" in the field of intangible cultural heritage.
Specifically, the title "Elite Artisan" in the field of intangible cultural heritage presented to Vietnamese individuals who are holding, practicing, teaching, and promoting the value of intangible cultural heritage of the following types: Voice, writing; folk literature; folk performing arts; social practices and beliefs; traditional festival; folk knowledge; Traditional handicrafts meet the following standards:
- Loyal to the Fatherland; Comply well with the Party's policies and the State's legal policies.
- Have good moral qualities; be exemplary in life; be enthusiastic and devoted to the profession; practice and protect intangible cultural heritage; and be recognized and admired by colleagues and people.
- Have particularly excellent talents or professional skills, typical of the type of intangible cultural heritage being honored; have great contributions recognized for the cause of protecting and promoting the value of intangible cultural heritage held by individuals, demonstrated in understanding and holding knowledge, know-how, and practical skills about types of intangible cultural heritage; have spiritual or material products of historical, cultural, scientific, artistic, aesthetic, and technical value, contribute to protecting and enriching the values of intangible cultural heritage, cultural, economic, and social development of local communities; teach many individuals who have been or are participating in protecting and promoting the value of intangible cultural heritage.
- Have a continuous or cumulative period of operation of 15 years or more related to the protection and promotion of intangible cultural heritage values.
Currently in Article 6 of Decree 62/2014/ND-CP, the criteria for awarding the title "Elite Artisan" to individuals who meet the following criteria: - Standards specified in Clause 1, Clause 2, Article 5 of Decree 62/2014/ND-CP; + Loyal to the Socialist Fatherland of Vietnam; Comply well with the Party's guidelines and policies and the State's laws, internal rules, and regulations of agencies, units, organizations, and localities; + Have good moral qualities and be exemplary in life; Enthusiastic and devoted to the profession, admired and respected by colleagues and the public; train individuals who are participating in protecting and promoting the value of intangible cultural heritage; - Have exceptionally excellent professional talents and great contributions, representing the cause of protecting and promoting the value of local intangible cultural heritage, demonstrated by holding skills and secrets for practicing intangible cultural heritage, having achievements, awards, spiritual or material products of historical, cultural, scientific, or artistic value, aesthetic or technical; - Have worked in the profession for 15 years or more. |
According to Article 6 of Decree 93/2023/ND-CP, individuals awarded the title "Elite Artisan" in the field of intangible cultural heritage will have the following rights and obligations:
- Individuals receive badges, certificates from the President, bonuses, and other benefits according to the provisions of the law.
- Individuals have the obligation to preserve reward artifacts; constantly improve knowledge and skills; actively practice, teach, and disseminate knowledge and skills; and participate in activities to protect and promote the value of intangible cultural heritage.
More details can be found in Decree 93/2023/ND-CP taking effect on February 15, 2024.
Decree 62/2014/ND-CP regulating the awarding of the title "People's Artisan" and "Artisan of Merit" in the field of intangible cultural heritage expires from the effective date of Decree 93/2023/ND-CP.
