On December 29, 2024, the Ministry of Labor, War Invalids, and Social Affairs issued Circular 16/2023/TT-BLDTBXH detailing and guiding the implementation of a number of articles of the Law on Emulation and Commendation in the fields of labor, people with meritorious service, and society.

Who is considered to be awarded the Commemorative medal "For the Cause of Labor, War Invalids, and Society" in Vietnam?

Subjects considered for awarding the Commemorative medal are individuals who have contributed greatly to the construction and development of the sector. There is only one class of Commemorative medals, and each individual can only be awarded once.

Criteria for awarding the Commemorative medal "For the Cause of Labor, War Invalids and Society" in Vietnam

Individuals working in the sector will be considered for the Commemorative medal when they meet one of the following criteria:

(1) Having worked for 15 years or more and always complying with the Party's guidelines, the State's policies and laws, and the agency's rules and regulations. Individuals who have worked in the field of labor—people with meritorious services and social affairs in other ministries, departments, branches, or provinces—but then moved to another sector to work—that time is accumulated to calculate the working time in the sector.

(2) Leaders of the Ministry, Leaders of Units Under the Ministry, Leaders of the Department of Labor, War Invalids, and Social Affairs who have worked continuously in the sector for 5 years or more if they are transferred to another ministry, department, branch, or province or are notified of retirement;

(3) Leaders at the rank of department level in units under the Ministry and its equivalents, leaders at the rank of department level in units under the Department of Labor - Invalids and Social Affairs and its equivalents, and leaders at the district level of the Department of Labor - Invalids and Social Affairs who have had continuous working experience in the sector for at least 10 years, if they are reassigned to work in other ministries, agencies, sectors, or provinces, or have retirement notification;

Individuals working outside the sector are considered for the Commemorative Commemorative medal when they have had a working period of at least 5 years (or at least one term of office for foreign individuals), and have closely coordinated with the sector to effectively implement policies or have outstanding and exceptional achievements in the fields of labor, contributions, and society.

Note: The consideration of awarding Commemorative medals to individuals who have reached the retirement age specified in (2) and (3) is carried out when there is a retirement notice from the competent authority.

No gifts will be considered for cases retiring from August 1995 or earlier, except for cases where, after retirement, they continue to participate in work and activities related to the field of labor, people with meritorious service, and society. (The working time before retirement is accumulated with the current working time to consider the gift.).

Individuals who meet the above conditions but are disciplined from reprimand to dismissal can only request to be considered for a Commemorative medal at the end of the disciplinary period. Disciplinary time is not counted as working time when considering awarding Commemorative medals.

More details can be found in Circular 16/2023/TT-BLDTBXH, taking effect on February 15, 2024. Circular 16/2023/TT-BLDTBXH replaces Circular 08/2019/TT-BLDTBXH dated March 8, 2019.
