Regarding this issue, LawNet would like to answer as follows:
On November 29, 2023, the Minister of Science and Technology issued Circular 22/2023/TT-BKHCN guiding the Law on Emulation and Commendation in the field of science and technology.
Criteria for awarding the Certificate of Merit from the Minister of Science and Technology in Vietnam (Latest)
Specifically, from January 15, 2024, the criteria for awarding the Certificate of Merit from the Minister of Science and Technology will be regulated as follows:
(1) The Certificate of Merit from the Minister of Science and Technology is awarded or posthumously awarded to individuals in the Ministry of Science and Technology who exemplify good compliance with the Party's guidelines and the State's legal policies and meet one of the following standards:
- Individuals who have been awarded the title "Grassroots Emulation Soldier" 02 consecutive times or have been recognized for excellently completing tasks for 02 consecutive years or more, during which time 02 initiatives were recognized and applied effectively within the facility;
- Typical and advanced individuals in emulation movements have the effect of setting an example and replicating within the Ministry;
- Individuals who have achieved many achievements in performing tasks or extraordinary achievements with scope of influence in the areas of management of the Ministry (achievements achieved outside of the program, tasks, and plans that the individual must undertake);
- Individuals with a history of contributing to the cause of building and developing science and technology (holding leadership or management positions at Department level or equivalent or higher but not having enough time to hold the position as prescribed to submit for State commendation);
- Individuals who have made many contributions to building the unit and the Ministry of Science and Technology, contributing to the development of science and technology, will be considered for rewards on the occasion of the anniversary (full year) of the unit's traditional day when meeting the following standards:
+ Have worked at the unit for 10 years or more;
+ Continuously complete tasks well or better, including at least 02 years of being recognized for excellently completing tasks within the time period for calculating achievements proposed for reward.
(2) The Certificate of Merit from the Minister of Science and Technology is awarded to exemplary collectives under the Ministry of Science and Technology that have well complied with the Party's guidelines and the State's legal policies and meet one of the following standards:
- The collective is recognized for successfully completing tasks for 02 consecutive years or achieving the title of "Excellent Labor Collective" and implementing well-emulation movements;
- Typical and advanced collective emulation movements, serving as an example and replication within the Ministry;
- Collectively set up extraordinary outstanding achievements with scope of influence in each field under the Ministry (achievements achieved outside of the programs, tasks, and plans that the collective must undertake);
- Collectives that have made many contributions to building the unit and the Ministry of Science and Technology, contributing to the development of science and technology, are considered for rewards on the occasion of the anniversary (round year) of the unit's traditional day when meeting the following standards:
+ Have a construction and development process of 5 years or more;
+ Continuously complete tasks well or better, including at least 02 years of being recognized for excellently completing tasks within the time period for calculating achievements proposed for reward.
(3) Other cases were considered and decided by the Minister.
More details can be found in Circular 22/2023/TT-BKHCN, taking effect on January 15, 2024.
Circular 16/2019/TT-BKHCN stipulates the awarding of Emulation Flags, Certificates of Merit from the Minister of Science and Technology, and Medals "For the cause of science and technology", Circular 21/2022/TT-BKHCN amending, supplementing, and abolishing a number of articles of Circular 16/2019/TT-BKHCN expires from the effective date of Circular 22/2023/TT-BKHCN.
Reward application documents sent to the Ministry of Science and Technology before Circular 22/2023/TT-BKHCN takes effect will continue to comply with the provisions of Circular 16/2019/TT-BKHCN on awarding Emulation Flags, Certificates of Merit from the Minister of Science and Technology, and Medals "For the Cause of science and technology", amended and supplemented in Circular 21/2022/TT-BKHCN.
