Regarding this issue, LawNet would like to answer as follows:
On February 28, 2023, the Central Executive Committee issued Regulation 100-QD/TW of 2023 on responsibilities, powers, and the appointment, dismissal, reward, and discipline of heads of the publishing house.
According to Article 5 of Regulation 100-QD/TW, the criteria and conditions for appointing heads of the publishing house are as follows:
- Ensuring general standards and specific standards of appointed titles according to regulations of competent agencies and organizations.
- A member of the Communist Party of Vietnam.
- Possess a high level of political theory.
- Graduated from university or higher. Possess a certificate of professional training in state management of publishing.
- Having worked in the field of journalism and publishing for at least 2 years. Special cases shall be considered and decided by the publishing and directing agency.
- Having complete dossiers certified by competent authorities (according to Appendix 2 of Regulation 100-QD/TW).
- About the age of the appointment
+ Heads of the publishing house under the Politburo and the Secretariat shall comply with the regulations of the Politburo and the Secretariat.
+ Heads of the publishing house for party or state agencies must have worked for at least one full term (60 months) or more.
+ Heads of the publishing house or mass associations assigned by the State must have worked for at least one full term (60 months) or more; The maximum age for holding a leadership position is not more than 65 years old for women and 67 years old for men.
In special cases not exceeding 70 years old, it shall be considered and decided by the agency directing the publication.
- The head of the agency managing the publishing house must not concurrently hold the position of head of the publishing house; The head of this publishing house cannot concurrently hold the position of leader of another publisher.
Article 6 of Regulation 100-QD/TW stipulates the number of heads of the publishing house as follows:
- The number of heads of the publishing house under the Politburo and the Secretariat shall comply with the regulations of the Politburo and the Secretariat.
- The number of heads of the publishing house under the Party and State agencies shall comply with the Party's regulations, the State's laws, and the regulations and laws of the governing body of the publishing house.
- The number of heads of the publishing house belonging to mass associations assigned by the state shall have 1 chief and a maximum of 3 deputy levels.
The process and procedures for appointing heads of the publishing house are based on Article 7 of Regulation 100-QD/TW, specifically:
- The process and procedures for appointing heads of the publishing house under the management of the Politburo, the Secretariat, and under the supervision of Party and State agencies shall comply with the Party's regulations and the State's laws; other relevant regulations of the competent authority.
- The process and procedures for appointing heads of the publishing house of mass associations assigned by the Party and State to comply with the Party's regulations, the State's laws, and the agencies in charge of publishing houses and publishing houses according to Section I of Appendix 1 to Regulation 100-QD/TW.
- The appointment of the head of the publishing house, which has not been adjusted by this Regulation, the governing body of the publishing house shall base itself on the Party's regulations and the State's laws and regulations of the publisher's governing body to carry out the appointment process and procedures in accordance with this Regulation.
- The term of appointment to hold the position is 5 years (60 months) for heads of the publishing house.
- The General Director, Director, Editor-in-Chief must not hold the position for more than 2 consecutive terms at a publishing house.
