The Ministry of Industry and Trade has just issued Circular 19/2019/TT-BCT stipulating the application of special safeguard measures to implement the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.
Currently, the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, abbreviated as the CPTPP Agreement, is a new-generation free trade agreement (FTA) consisting of 11 member countries: Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, and Vietnam.

Circular 19/2019/TT-BCT regulates the application of special safeguard measures to implement the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, including: Transitional safeguards and emergency measures for textiles.
To be specific: Article 4 of Circular 19/2019/TT-BCT stipulates that the relevant parties in the investigation, application of transitional safeguard measures, and emergency measures for textiles include:
- Organizations and individuals from member countries producing and exporting goods under investigation into the territory of Vietnam;- Organizations and individuals importing goods under investigation;- Associations from member countries with the majority of members being organizations and individuals producing and exporting goods under investigation;- The Government of Vietnam and the competent authorities of the exporting member countries under investigation;- Organizations and individuals with dossiers requesting the application of transitional safeguard measures and emergency measures for textiles;- Domestic organizations and individuals producing similar goods, directly competing goods;- Domestic associations with the majority of members being organizations and individuals producing similar goods, directly competing goods;- Other organizations and individuals with lawful rights and interests related to the investigation or can aid the investigation process or representative organizations protecting consumer rights.
Note that organizations and individuals must register and be accepted by the Investigating Authority to become related parties in the investigation in accordance with the provisions of the Law on Foreign Trade Management regarding registration procedures.
Related parties in the investigation shall have access to information and documents provided by other related parties to the Investigating Authority as per the provisions of Clause 2, Article 75 of the Law on Foreign Trade Management and Article 11 of Decree 10/2018/ND-CP.
