Covering Up Subordinate Violations May Result in Demotion in Military Rank

In 2016, Circular 192/2016/TT-BQP was signed and promulgated by the Ministry of National Defense, stipulating the application of disciplinary forms, order, procedures, statute of limitations, duration, and authority for disciplinary actions within the Ministry of National Defense.

According to Circular 192/2016/TT-BQP, if the policies on the responsibilities of commanders are violated, the following disciplinary measures may be imposed:

- The direct commander and one level above, due to a lack of responsibility in management and command, allowing service members, workers, and defense public employees under their authority to violate state laws, military orders, and regulations to the extent that disciplinary action or criminal prosecution is necessary, shall be subject to disciplinary reprimand or warning.- If any of the following cases occur, disciplinary actions ranging from demotion, dismissal, salary downgrade, to reduction of military rank shall apply:- Knowing or detecting the signs of subordinates' offenses but failing to take prompt measures to prevent them;- Covering up for the offenses of subordinates.
