Coordination of Sector-specific Labor Inspections: What Procedures Should Be Followed?

To protect the rights of workers, our State has issued numerous policies to enhance the effectiveness of labor inspection. One of these is Circular 20/2018/TT-BLDTBXH, guiding the coordination mechanism for conducting specialized inspections of labor, labor safety, and hygiene at night and outside of official working hours.

According to the new regulations, the coordination of labor sectoral inspections between agencies shall be carried out in the following order:

- Within a maximum of 04 hours from the establishment of a labor violation case, the Chief Inspector of Ministry of Labor, Invalids, and Social Affairs (MOLISA) or the Director of the Department of Labor, Invalids, and Social Affairs (DOLISA) where the incident occurs shall notify the leading unit at the relevant functional agencies, the police agency, and the local government to confirm participation in the inspection team.- Within a maximum of 04 hours from the notification, the Chief Inspector of MOLISA or the Director of DOLISA or the Chief Labor Inspector where the incident occurs shall issue an Inspection Decision.- Within a maximum of 12 hours from the signing of the sudden Inspection Decision, the Head of the inspection team must announce the Inspection Decision, and at the same time, conduct the inspection at the violation site.- Implement or propose to implement measures to handle the violation.
